Stop Foreclosure - Five Options You Need To Know

You'll feel better when you know your options.

How To Find A Lawyer To Stop Foreclosure

By Steve M. Bingman

If you have looked on the internet for stop foreclosure help, you have seen a number of websites claiming to be "stop foreclosure specialists". To me, most of these "stop foreclosure specialists" websites are bogus. There is not a government or private organization that certifies "stop foreclosure specialists". I believe that most of these websites cannot give you valid legal advice. Instead they want to make you a high interest rate loan, buy your house for an amount below its market value, or charge you for talking to your mortgage lender.

The truth is that foreclosure is a legal action. Do you want to take advice from a self proclaimed "stop foreclosure specialist" without legal training or take advice from a lawyer licensed in your state. I would prefer to get advice from someone who can explain in detail what is the foreclosure process in my state and what are my legal rights. I would also want someone who can explain what are my options after taking into consideration my situation. Lawyers are trained to look at situations and then determine a course of action that is best for the client.

To find a lawyer to stop or avoid foreclosure, you should first look for a lawyer who handles bankruptcy, bad credit matters, and real estate. The reason for looking at these three areas is because "stop foreclosure" is not a legal specialty and because foreclosure may touch all three areas.

Foreclosure is basically a debt collection process whereby a mortgage lender seeks to recover money by enforcing the mortgage lender's lien against your house. The mortgage lender will either get your house at the end of the foreclosure process or get money from the foreclosure sale. In some cases, a lender may get money in addition to your house.

Bankruptcy lawyers are use to handling matters whereby clients seek to stop debt collection. And real estate attorneys are use to handling matters that deal with the legal title to your home. Foreclosure deals with both areas of law.

To find a lawyer, you can talk with family or friends, look at the local phone directory, or look on the internet. Call several lawyers because some will be more helpful than others and because some will charge more than others. Explain that your are facing foreclosure and that you need to know what are your options and what are your legal rights. And find out upfront what the lawyer will charge for a consultation.

Remember, you may have several options to stop or avoid foreclosure and that not every option will work in every situation.

This article is general information. If you have any questions of any nature concerning stopping foreclosure, talk with a lawyer licensed in your state.
